Paternity Leave Options For Service Personnel

There are two options when it comes to paternity leave and, as with all allowances, there are eligibility requirements. You are advised to read through JSP 760 to establish what could be available to you.

The Armed Forces Occupational Paternity Leave Scheme

Qualifying Service personnel are eligible to apply for two weeks of paid paternity leave at the time of birth or placement of a child . There are certain eligibility criteria which you are required to meet in order to be eligible for this. The Armed Forces Occupational Shared Parental Leave Scheme

In some cases, the Service person may be eligible to receive Shared Parental Leave . Again, this is subject to eligibility criteria based upon your individual circumstances. For more information about your personal eligibility for ShPL, please discovermybenefits.mod.gov.uk/army/army-health-welfare/health-and-welfare-shared-parental-leave.

Deferral of Paternity Leave and Shared Parental Leave

Members of the Armed Forces have a commitment to be available to serve at short notice. For this reason, Commanding Officers have the discretion to defer both Paternity and Shared Parental Leave if operational circumstances require it. Personnel may also be recalled from their leave if required.

At Your First Duty Station

Once you have completed basic training and report to your first duty station, you are officially serving in the United States Military. There are few, if any opportunities for an entry-level separation at this stage, and you are required to meet the terms of your enlistment contract or commission.

There are few provisions for early outs, quitting, or abbreviated tours unless the Defense Department decides it is in their best interest to let you go before your original commitment ends. What Are the options for someone who has graduated and is currently serving who wants to quit the military?

Administrative Separation is one option. This is usually initiated when a service member is deemed unable to adapt to military life. An Administrative Separation, also referred to as an admin sep can be approved by a chain of command in some cases. This process may be used as an alternative to punishment via the Uniform Code of Military Justice, Captains Mast, non-judicial punishment, etc.

Admin seps can be used against those who dont manage their military travel credit card accounts as required, for failing to meet fitness or training standards, etc.

In some instances, Breach of Contract makes the military choose to separate a soldier, sailor, airman, or Marine if there was deception used by the recruit when being screened by a recruiter.

Where Will I Be Based

However, there are also lots of specialist training bases that you will have to visit, sometimes for several weeks at a time. Dont forget that you could also be deployed for up to six months in operational duties around the world. This could be anything from providing humanitarian aid in war-torn countries, to enforcing anti-terrorism measures.

So if youre a home bird who likes their creature comforts, you may want to reconsider joining the armed forces – or opt for the Reserve Forces instead.

It is possible to quit Army basic training if you take action early. The military allows for those who change their minds in early training in their administration. The two ways to leave basic training without punitive effects are the Delayed Entry program Discharge and Entry Level Separation.

If you try out basic training and you think youre not making the cut, or something comes up in your personal life which changes your ability to ship out, you can be discharged from the Army. We will discuss Delayed Entry Program Discharge and Entry-Level Separation in more detail below.

Valid Reasons For Discharge

There are many conditions or circumstances which can lead to a general or even honorable discharge. It goes without saying that you cannot simply abandon your duties as a soldier and expect clemency.

Attempting to leave the service without a valid reason can result in punitive action and loss of entitlement to benefits, so its best to be careful about how you approach your separation from the military.

Valid reasons for honorable or general discharges include but are not limited to:

  • Completed term of service.
  • Psychological conditions that interfere with service.
  • Failure to meet physical or psychological standards.
  • Medical condition interfering with service.
  • Need to care for dependents.

Outside of these reasons, most discharges are considered other than honorable or dishonorable. These types of discharges disqualify you from receiving VA benefits and can even result in punitive action for grievous offenses.

Completing your full term of duty is the best way to be discharged. This completion means that a person retains your entitlement to VA benefits and looks good on a resume to boot. A general discharge is the next best thing and can result from a variety of things, including medical conditions or a need to care for independents.

Preparation Is Key To Emergency Leave

The most important thing to do to be able to take emergency leave when you need to is to be prepared. Members of the military may go overseas or be on a mission without access to cell phones where it is not easy for family to contact them.

With this in mind, make sure your immediate and close family members know the following information about you and your unit.

  • Home Base Unit Information and Deployed Unit Information
  • Your First Sergeants Phone Number

Your family will need to call the American Red Cross at 1-800-733-2767 to relay this information and give the details on the immediate family member. Your family will need to have the following information.

  • Name and relation to immediate family member experiencing the emergency
  • Nature of the emergency
  • Where the emergency can be verified

Register Your Serving Spouse Or Civil Partners Details

Soldiers can now register their serving spouse or civil partners details with their career manager.

This is so that both your career managers can liaise with each other during the assignment process to allow co-located/accompanied Service where possible.

However, assignments in the same general area cannot be considered a right, nor should the interests of other soldiers be allowed to suffer as a result of the policy.

When Can You Take Leave

Service members may request leave at any time. Approval will be at the discretion of the command, based upon a wide variety of factors including operational requirements.

Some commands may have specified times when all or portions of the command can take leave at the same time. This is sometimes referred to as block leave and may happen before or after a deployment or during a holiday period. Commonly, block leave time is allowed during the summer and Christmas holidays, and before and after deployments.

    What Happens If You Quit Your Military Contract

    If you quit your military contract, either you will face charges or be released without any punitive results. The consequences depend on when and how you are discharged. Going AWOL carries serious penalties while honorable discharge does not.

    Typically, to get an honorable discharge, you must serve your full period of active duty. The minimum term of enlistment is two years. A soldier may be honorably discharged after this period has elapsed without any misconduct or other problems. Soldiers discharged for psychological or medical reasons may also be honorably discharged without finishing their full term.

    85% of veterans are able to leave the military with an honorable discharge. This type of discharge entitles the veteran to VA benefits, such as education and healthcare.

    Other forms of discharge are less favorable. However, not all of them are bad or punitive. As mentioned before, psychological or medical discharges may still be considered honorable discharges under certain conditions.

    Some types of discharge are considered bad and may come with punitive action. These include other than honorable discharges, bad conduct discharges, and dishonorable discharges. Depending on the nature of the conduct which led to the discharge, the soldier may be sentenced to jail time or other punishments.

    If a future job prospect requires a background check, it is more than likely that a dishonorable discharge or OTH discharge could jeopardize your chances at the position.

    Recruiters will tell a recruit, sure, sign up now, get through medical , and when you get to your A-School, you can try out for jobs like Navy SEAL, SWCC, Diver, and EOD . If you get told this – walk out of the recruiter office because that is a lie. The way this works is to get it in your contract that you are part of the Warrior Challenge and you then have to start taking fitness tests with an area SEAL / Diver Mentor. Unfortunately, some people are told they can take the test at boot camp or after boot camp at A school. It used to be this way back in the 1990’s – not any more. But, once again, if you do not do your research for your future profession, you will not know this. You must put in the time. Treat this like a job interview and learn as much as you can about the process from your recruiter then verify. In this case, you should read the SEAL / SWCC Website – all of it. Then prepare properly for the physical challenges in front of you – which are many. In this case, if you fail the fitness test at any time before, during, or after boot camp, you lose the contract to go become a SEAL, SWCC, EOD / Diver, or Air Rescue.
